On July 1, 2025, all Colorado Clerk and Recorder Offices, like here in El Paso County, will charge a new $43 flat fee for recording documents. This fee change complies with House Bill 24-1269, passed by the state and signed into law last year.
The new state law requires all documents recorded with the El Paso County Recording Department, no matter the page count or size, to be charged a flat fee of $40. A $1.00 Electronic Recording Technology Board (ERTB) surcharge and a $2.00 electronic filing surcharge will remain in effect, bringing the total to $43. Death documents recorded into real estate records, such as death certificates, are exempt from fees and will be recorded for free. This law not only changes recording fees, but also repeals old fees. It also extends the repeal and sunset review of the Electronic Recording Technology Board.
