Beginning July 1, 2025, all Colorado Clerk and Recorder Offices, including here in El Paso County, will implement a new $43 flat fee for recording documents. This fee change complies with House Bill 24-1269, passed by the Colorado General Assembly and signed into law last year.

The new state law requires all documents recorded with the El Paso County Recording Department, no matter the page count or size, to be charged a flat fee of $40. A $1.00 Electronic Recording Technology Board (ERTB) surcharge and a $2.00 electronic filing surcharge will remain in effect, bringing the total to $43. Death-related documents recorded into real estate records, such as death certificates and verification of death documents, are exempt from fees and will be recorded for free. This legislation not only modifies recording fees, but also repeals outdated fee categories, extends the repeal and sunset review of the Electronic Recording Technology Board, and provides new appropriations.
